OBJET : Projet de Constitution de l’Union européenne

A l’attention des Entrepreneurs en Europe

Et à l’attention de leurs collaborateurs et personnels d’entreprises, tous statuts compris

Le Projet de Constitution de l’Union Européenne s’avère très différent de la présentation publique qui en a été faite par battage médiatique, nous disons plus volontiers par tapage médiatique, … Après examen par nos soins, et encore non exhaustif, ce projet est totalement opposé à la Convention européenne de sauvegarde des droits de l’homme et des libertés fondamentales, dite plus couramment Convention Européenne des Droits de l’Homme (CEDH).

La notion de sauvegarde implique sans ambiguïté que les droits et libertés qui constituent cette Convention sont un minimum, rendant ainsi injustifiable un renouvellement de rédaction avec réduction des cas prévus de droits et libertés, d'ailleurs la refonte de ce texte a en effet été justifiée par la seule nécessité d’organiser la répartition de la prise en charge des droits et libertés entre l’Union et les Etats membres.

Le Projet dénature la Convention altérée au moins sur trois points par l’élimination pure et simple de droits et libertés qui garantissent tous les autres :

1° garantie de l'application effective des droits et libertés, CEDH Préambule et article 52,

2° se défendre par soi même dans une procédure juridique, CEDH 6.3.c),

3° recours effectif pour des violations des droits et libertés même par des personnes dans l'exercice de leurs fonctions officielles, CEDH 13.

La répartition à personne ou au gré de la fantaisie de l’on sait qui, de la prise en charge de ces droits et libertés est contraire à la Constitution française article 2 (La République) Son principe est : gouvernement du peuple, par le peuple et pour le peuple. ", nous souhaitons en informer notamment le secteur industriel car par ailleurs d’autres faits rendent ce texte anti-démocratique, anti-libéral et dictatorial, les documents ci-joints établis par nos soins en font la présentation.

The Project of Constitution of the European Union proves very different from the public presentation which in was made by media beating, we say more readily by media din… After examination by our care, and still nonexhaustive, this project is completely opposed to the European Convention of safeguard of the humans right and of fundamental freedoms, said more usually European Convention of the Humans Right (ECHR).

The concept of safeguard implies without ambiguity that the rights and freedoms which constitute this Convention are a minimum, making thus unjustifiable a renewal of drafting with reduction of the cases envisaged of rights and freedoms, moreover the recasting of this text was indeed justified by the only need for organizing the distribution of the assumption of responsibility of the rights and freedoms between the Union and the Member States.

The Project denatures the Convention deteriorated at least on three points by the pure and simple elimination of rights and freedoms which guarantee all the others: 1° guaranteed effective application of the rights and freedoms, ECHR Preamble and article 52, 2° to defend oneself by oneself even in a legal procedure, ECHR 6.3.c), 3° effective recourse for violations of the rights and freedoms even by people in the exercise of their official functions, ECHR 13.
